• •Account Confidentiality: You bear sole responsibility for safeguarding the strict confidentiality of your account credentials (e.g., passwords, multi-factor authentication codes, API tokens). Fixey Platforms strictly prohibits the shared usage of individual accounts unless explicitly authorized via an enterprise license.
• •Liability for Actions: You accept paramount responsibility for any and all activities, communications, transactions, and breaches that occur under your registered account. Suspected unauthorized utilization of your account must be reported to our incident response team immediately.

We grant you a limited, non-exclusive, non-transferable, and highly revocable license to access and employ our platforms purely for their intended functional purposes, strictly in accordance with this Agreement. You explicitly agree that you shall not, under any circumstances, engage in the following prohibited actions:

• •Illegal Activity: Utilize our platforms to execute, promote, facilitate, or conceal any fraudulent, unlawful, or socially harmful activities across any jurisdictions globally.
• •System Compromise: Attempt to decipher, decompile, reverse engineer, intercept, or circumvent any encryption, firewall configurations, or administrative protocols securing our platforms, source code, network architectures, and proprietary algorithms.
• •Malware Distribution: Distribute, upload, transmit, or otherwise propagate any malicious computer code, malware, spyware, trojans, ransomware, or logic bombs calculated to disrupt, damage, or limit the functionality of our computational systems or the systems of other users.
• •Data Harvesting & Scraping: Deploy unauthorized automated agents, web crawlers, scrapers, bots, or spiders aimed at extracting, systematically downloading, harvesting, or mapping critical data arrays, user profiles, or proprietary algorithms without our written, explicit consent.
• •Network Overload: Intentionally overload, flood, spam, or perform distributed denial-of-service (DDoS) attacks against our localized or cloud-based hosting frameworks, disrupting the robust access to other paying clients.

Certain segments of our platform operations and software development services demand monetary compensation. By opting into a paid tier, custom project, or subscription model, you mathematically bind yourself to the following stipulations:

• •Accurate Billing: You shall provide completely valid, thoroughly verifiable, and up-to-date payment instruments. All fiscal transactions are processed logically via encrypted, certified third-party payment gateways (e.g., Stripe, PayPal).
• •Automatic Renewal Parameters: Except where strictly delineated, all monthly and annual subscriptions inherently auto-renew. The renewal dynamic charges the default payment method automatically at the inception of the subsequent billing cycle. To halt auto-renewal, proactive cancellation is decisively required prior to the renewal date threshold.
• •Taxes and Surcharges: All published fees may be completely exclusive of mandatory localized or international value-added taxes (VAT), goods and services taxes (GST), or other statutory levies, which shall be additionally calculated and collected precisely at checkout as required by global law.
• •Refund Protocols: Our operational refund paradigms are exceptionally rigid. All fiscal transactions are final unless explicitly governed by a superseding master software development contract or our formal Refund Policy.

The protection of our intellectual property is paramount to Fixey's competitive advantage in frontier technology.

• •Fixey's Ownership: All integral components encompassing our platforms—such as source code intricacies, specialized AI algorithms, robotic processing automation scripts, UI/UX designs, trademarks, service marks, logos, commercial databases, and multimedia content—are the exclusive, undeniable intellectual property of Fixey Software Solutions (Pvt) Ltd. These assets are comprehensively shielded by prevailing copyright, trademark, patent, and trade secret frameworks under domestic and international law.
• •User-Generated Content: For any raw data, imagery, reviews, code snippets, or configuration macros you actively upload to our public hubs or project dashboards ("User Content"), you steadfastly retain your origination ownership. However, you perpetually grant us a worldwide, royalty-free, irrevocable, sublicensable, non-exclusive license to host, display, logically modify, reproduce, and transmit said content exclusively for the purpose of operating, improving, and promoting our platform functionalities.
• •Prohibition on Reproduction: No overarching segment, code snippet, aesthetic framework, or functionality from our platforms may be copied, reproduced, repackaged, publicly displayed, or systematically commercialized without possessing a drafted, digitally signed framework agreement from the board of Fixey Platforms.

We operate under zero-tolerance frameworks for malicious or unauthorized activities. Fixey Platforms holds the unilateral, absolute right to swiftly suspend, decisively terminate, or permanently ban your account and generalized access to our networks without prior formal notice or fiscal liability.

Conditions spurring such deactivation include, but are not limited to: verifiable breaches of these Terms, detection of persistent algorithmic abuse, fraudulent fiscal transactions, chronic non-payment, litigation risks, or prolonged inactivity extending beyond twenty-four (24) consecutive months. Following termination, all your explicit rights to utilize the platforms vaporize instantly, and any data tied to your account may be permanently, irrecoverably purged from our active server environments.

No Warranties: All Fixey Platforms and Services are delivered strictly "as is" and "as available." We categorically disclaimer all explicit and implicit warranties, including merchantability, fitness for a particularized purpose, continuous uptime, bug-free assurances, and absolute immunity from hacking.

Capped Liability: To the absolute maximum threshold permitted by robust international jurisdictions, Fixey Software Solutions (Pvt) Ltd, its overarching directors, corporate officers, senior engineers, and affiliates shall bear zero liability for any strictly indirect, subsequent, punitive, incidental, or exemplary damages—including acute loss of vast profits, computational data corruption, operational standstill, or severe reputational damage—stemming from your functional use, or inability to use, our platforms.

Financial Ceiling: Should a court of competent, unappealable jurisdiction determine liability exists against Fixey, our maximum aggregate, collective liability for any and all combined claims related uniformly to the platforms or this agreement shall be decisively capped at the lesser of (a) the aggregate sum you effectively paid us utilized expressly for the services in the prior three (3) calendar months preceding the incident, or (b) One Hundred United States Dollars ($100.00 USD).

You explicitly agree to fully indemnify, forcefully defend, and hold eternally harmless Fixey Platforms, its operational subsidiaries, and their collective personnel from any formidable demands, claims, civil damages, liabilities, legal proceedings, and financial expenses (not excluding reasonable attorney retainer fees) resulting directly from your explicit violation of these Terms, your documented misuse of the platform resources, or your severe infringement of any third-party intellectual property or privacy statutes.

These intricate Terms shall be exclusively governed, critically construed, and intensely enforced under the sovereign laws of the Democratic Socialist Republic of Sri Lanka, entirely disregarding its complex conflict of law matrices.

Any escalating dispute, controversy, or civil claim arising out of your nexus with our services must traverse immediate good faith negotiation channels for no less than thirty (30) days. Should formal negotiation categorically fail, the conflict shall be exclusively submitted to binding commercial arbitration or the formal judicial structures strictly located within Sri Lanka, and you thereby submit resolutely to the exclusive personal jurisdiction of said local tribunals.

Due to the exponential advancement of our AI integrations and the fluid nature of software legalities, we reserve the unalienable right to alter, heavily revise, or completely rewrite these Terms at our total discretion. Any shifts will be reflected functionally by updating the "Last Updated" date atop this page.

Your persistent, continuous utilization of our expansive platforms immediately following the posting of new structural Terms firmly constitutes an indisputable, binding agreement to comply with the modernized provisions.
